Mike 'Boogie' Malin is in hot water -- again -- this time, for hitting up Los Angeles pharmacies and allegedly leaving without paying for a bunch of stuff ... TMZ has learned.

The Burbank Police Department tells TMZ ... the '"Big Brother" season 7 alum was arrested on January 29 after officers were dispatched to multiple CVS Pharmacy locations in the San Fernando Valley regarding shoplifting incidents.

Law enforcement sources tell us an employee from the first CVS told cops he confronted Malin outside the store and told him he needed to pay for the items he'd stolen. Malin went back into the store with the items, placed them on the ground, and departed the premises in his vehicle.

Fyre Festival creator Billy McFarland is rejecting all the "comeback is bogus" talk -- he’s doubling down on his vision, insisting the second time around, it's moving forward full force, no matter what.

In an IG vid Tuesday, Billy responded to reports the Isla Mujeres tourism board in Mexico recently denied knowing anything about Fyre Festival 2. Billy said the festival has contracts with "a number of villas, yachts and hotels" -- and he specifically called out two hotels that were "contacted by the media, and in response, gave misleading statements saying they never heard of Fyre and they aren't working with us."

In response, he says, he told his team to terminate those contracts ... and to concentrate on working with eager partners on the project.

Bryan Kohberger's attorney is arguing her client's autism diagnosis should prevent a death penalty sentence in the event he's found guilty of murdering four college students ... stating capital punishment would constitute "cruel and unusual punishment" due to his inability to fully understand the consequences.

Attorney Anne Taylor filed a motion last week stating if her client were to be found guilty and sentenced to death, that would violate his Eighth Amendment constitutional rights. Kohberger, accused of murdering four University of Idaho students in the dead of night in 2022, was formally diagnosed by a neuropsychologist last month.

A neuropsychologist evaluated Kohberger and found he "continues to exhibit all the core diagnostic features of ASD currently, with significant impact on his daily life.”

Chaos ensued on the '80s-themed Royal Caribbean cruise when the fiancée of Faster Pussycat's lead singer went overboard ... and only TMZ has video of the rescue efforts.
